Terms and Conditions of Sale

1. General

In these Terms and Conditions of Sale, “PR Guru”, “us” or “our” means JMM Communications Pty Ltd ACN 53 007 061 556 trading as PR Guru and any Related Body Corporate as defined in section 9 of the Corporations Act 2001 (Cth)

The PR Guru website (“the Website”) is owned and operated by JMM Communications Pty Ltd of Level 1, 23 Cardigan Place, Albert Park, Victoria, 3206.

These Terms and Conditions of Sale apply to the use by the customer (“you” or “subscriber”), and to the supply of all products and services by PR Guru to you. By placing an order with the Website you indicate that you have read, understood, accept and are bound by the Terms and Conditions of Sale.

PR Guru and its associated businesses reserve the right to make changes to the Terms and Conditions of Sale at any time and for any reason. We will notify you on the Website 7 days prior to the changes taking effect and your ongoing use of the Website constitutes your acceptance of the changes.

2. Purchase Order

A contract between you and PR Guru for the sale of any of our products and/or services will only exist once an order has been submitted, accepted, processed, paid for and downloaded.

PR Guru provides three key publicity services that can be ordered in three different ways.

  1. Write my press release

    Upon submission and order of the press release details, you will receive a confirmation receipt via email, a log in identification number and a press release order form/Questionnaire which you are required to complete and submit.

    Upon receipt of your Questionnaire, you will receive the first draft of your press release within four working days. Further amendments will be made to your press release depending on the service that you have ordered.

    With our ‘Express’ service, we will provide you with a press release within 24 hours or 1 working day upon receipt of your Order form/Questionnaire. However, if the Questionnaire is received at 4:50pm or later on a Friday evening Eastern Standard Time, then it will be available at 4:50pm or later the following Monday.  

  2. Media Database

    Upon your order being received and confirmed you will be emailed a receipt and then emailed an attachment containing the media database that you purchased.

    Every attempt is made to maintain the media database with current contact details of media representatives. Although we try our best to maintain a current database, its accuracy cannot be guaranteed as details of our contacts are always changing.

  3. PR Guru DIY Publicity Guide

    Upon your order being received and confirmed you will be emailed a receipt for your purchase. We will separately email your e-book purchase as an attachment. All e-books are in PDF format. Once your order has been submitted there can be no cancellation.

3. Payment Methods

PR Guru accepts online payment in a secure environment. Visa and Mastercard are the forms of payment that we accept. All prices quoted on the Website are accurate at the time of publication and are quoted in Australian dollars (AUD). 

4. Changes to Prices

Prices and availability of online goods and services are subject to change without notice.

5. Goods and Services Taxes (“GST”)

All transactions are inclusive of GST. No customers are eligible for tax exemptions for transactions made on the Website.

6. Delivery

Please ensure that the details provided to us in relation to your purchase(s) are accurate and complete as we are unable to change any details once the order has been placed. PR Guru will not take responsibility for any orders that go missing due to incorrect delivery information provided by you.

7. Refund Policy

PR Guru is committed to giving you the best possible advice, media lists and press release writing services. If for any reason you are not satisfied with your products and/or services please contact us at prguru@prguru.com.au and we can discuss your concerns and if appropriate we will provide you with a refund or replacement product.

8. No Warranties

Neither PR Guru, or any third parties provide any warranty or guarantee in relation to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on the Website is entirely at your own risk, including any subsequent media interviews, media coverage or other result obtained, for which we will not be liable. It is your own responsibility to ensure that any services or information available through the Website meet your specific requirements.

9. Exclusion of Liability

To the maximum extent permitted by law, we exclude ourselves and our suppliers of software incorporated in the Website, all liability for all claims, expenses, losses, damages and costs made against or incurred or suffered by you directly or indirectly (including without limitation lost costs, profits and data) arising out of your use or misuse of the Website or materials (including all media releases) or other product or service provided by us to you.

PR Guru and its associated businesses assume no responsibility for any user's activities on the Website or for the inaccuracy of any content on the Website or in a media release or in any subsequent media coverage or publishing elsewhere, including other websites.

You agree that PR Guru and its associated businesses are not responsible, and will not be held liable, for any third party content on the Website or any third party content, products or services available on other websites accessed through links from the Website. Links to third-party sites are for your convenience only, and their inclusion on the Website does not imply any endorsement, guarantee, warranty or representation by PR Guru or its associated businesses.

10. Limitation of Liability

If we breach any express provision of these Terms and Conditions of Sale, or a condition or warranty implied under any law which cannot be lawfully modified or excluded by the Terms and Conditions of Sale, then our liability to you will to the extent permitted by law, be limited at our option to supplying the products and/or services again. Our liability to you for loss or damage of any kind (including loss or damage caused by negligence) is reduced to the extent that you caused or contributed to that loss or damage.

11. Right of Refusal and Fair Use

PR Guru reserves the right to refuse to fulfill an order at any time, without the need to give reasons.

PR Guru reserves the right to reject any press release submission for any reason whatsoever, without explanation. PR Guru also reserves the right to reject any press release application that the service moderator believes is not suited to uploading on the Website.

You are responsible for ensuring that you are familiar with the Spam Act 2003, and that your communications with the media and/or recipients of your material(s) do not breach the Spam Act 2003.

12. Provision of Information

PR Guru will not be responsible for any deficiencies in information given to us by you or anyone acting on your behalf which causes our service to you to be compromised in any way. We reserve the right to refuse to undertake a service in relation to information or material provided by you, which we believe to be contrary to Victorian law or statute, offensive or otherwise inappropriate. We will not enter into any further correspondence with you if we decide at our discretion to refuse to undertake a service.

13. Copyright Notice

Any redistribution or reproduction of part or all of the contents in any form that has not been purchased pursuant to the Terms and Conditions of Sale is prohibited. Except as specifically permitted in the Terms and Conditions of Sale or by express written consent of PR Guru, you may not use the Website or the material on the Website in any manner.

14. Privacy

PR Guru is committed to protecting your privacy and security. We will use and disclose your personal information for the primary purposes of our business and to facilitate your purchase or in providing the service that you have ordered. For more information please refer to our Privacy Policy.

15. Governing Law and Choice of Forum

The Terms and Conditions of Sale is governed by the laws in force in the State of Victoria, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of the State of Victoria, Australia and any courts which may hear appeals from those courts.

PR Guru makes no representation or warranty that the content and materials on the Website and/or the Services are appropriate or available for use in locations outside Australia. Those who choose to access the Website or use the services from other locations do so at their own risk, and are responsible for compliance with local laws, if and to the extent applicable. PR Guru reserves the right to limit the availability and accessibility of the Website its services to any person, geographic area, or jurisdiction we so desire.
